Nebraska lawmakers are pushing for the state to legalize online sports betting as two bills are carried over to 2026 and are currently being active considered, but what are the odds sportsbooks actually become legal for the state’s residents?

Nebraska has several live casinos that offer slots, poker, and horse racing betting opportunities, but all of the state’s legal betting is done in person. Online betting is illegal in Nebraska, so the state doesn’t have regulated online alternatives. Nebraska lawmakers attempted to legalize online sports betting for some years now, but all previous efforts have failed to date.

2026 could mark the first time in recent years where Nebraska measures for a state-regulated online betting platform could realistically advance in a changing environment.

Legalizing online sports betting requires Nebraskan lawmakers’ approval or voter approval

There are currently two active bills in Nebraska that are attempting to legalize online sports betting, and both are significantly different, even while trying to accomplish the same goal.

Legislative Bill 421 wants to change the law by creating a regulatory framework in the Nebraska Racetrack Gaming Act. The law would limit online sports betting to licensed racetrack gaming operators who can offer their own platform or partner with others. The Nebraska Racing and Gaming Commission would oversee the sportsbooks to ensure sufficient state regulations are met.

The commission would also check internal controls of the sportsbooks, and operators would be required to have anti-fraud, anti-corruption, and age‑verification safeguards in place. A 20% tax on revenue would be charged on the revenue of any participating betting platforms, which is identical to how legal in-person retail alternatives are handled in Nebraska.

It’s estimated that the online betting revenue generated could be over $9 million in the first year alone, with the number potentially rising to more than $20 million by the fourth year of legal operations in Nebraska. The generated revenue would be used for state welfare funds, with the majority going towards property tax relief, and smaller portions to racetrack regulation and gambling assistance programs.

Legislative Resolution 20CA is the second bill in the 2026 session, which takes a different approach towards the same ultimate goal: the legalization of online sports betting in the US state of Nebraska.

The resolution proposes that online betting sites partner with racetracks, but LR 20CA is more flexible compared to LB 421. If the Nebraska legislature approves it, the bill will be added to the November 2026 general election ballot. Nebraska residents will then have the power to either make online sports betting legal or maintain prohibitions against it.

The voting for LR 20CA is more complicated than LB 421, as there are requirements as to how many registered voters must vote in order to move forward with a positive result. But if approved, the resolution could trigger a statewide online sports betting market that would be expected to bring in roughly $30 million in taxes, which could then be used to provide tax relief to Nebraskans.

While the online betting tax revenue figure may seem too good to be true, other US states, such as Virginia, have proven just how successful legalized sports betting can be for states that regulate and tax the practice.
