Mizkif gets bad news on lawsuit against Asmongold, Emiru, OTK
Matthew “Mizkif” Rinaudo filed a lawsuit against multiple streamers, including Zach “Asmongold” Hoyt, as well streamer organizations including OTK, following allegations made by Emily “Emiru” Schunk. And unfortunately for Mizkif, public filings show that the lawsuit has now taken a major hit.
Emiru made public her allegations of harassment against Mizkif, which led to the controversial streamer facing severe backlash from around the streaming community. Mizkif responded to the accusations and then publicly announced that he was suing Emiru, Asmongold, and OTK Media for defamation.
There has since been significant movement in the case, with at least one of the claims having been dismissed entirely.
Court dismisses Mizkif defamation lawsuit against Asmongold
New court filings have been made public, showing that a judge ruled in favor of Asmongold while dismissing Mizkif’s defamation claims against him, with prejudice.
Mizkif’s attempt at suing
opposing streamers mentions Asmongold, Emiru, and content organizations One True King, Mythic Talent, and King Gaming Labs. A recently court document specified that Asmongold filed a motion with the court to dismiss the claims against him, and that claim was approved.
Mizkif was apparently asked to provide any instances in which Asmongold knowingly spread fake or defamatory statements about him. The streamer reportedly was unable to offer when any such qualifying statements were made, leading to the judge ruling decisively in favor of Asmongold. The judge apparently ruled with prejudice, essentially meaning that Mizkif can’t file the same lawsuit against Asmongold again in the future.

Asmongold hasn’t spoken about the judgment publicly yet, but the streaming community is already brimming with discussions about the dismissal.
Mizkif had recently been streaming the court documents related to
John “Tectone” Robertson’s ongoing lawsuit, and many asked the streamer to focus on his own legal battles given this latest turn against him. Others were even more critical, questioning why Mizkif filed the lawsuit to begin with if he didn’t have any of the required evidence of Asmongold actively defaming him.
Some are already speculating that the claims against Emiru and the other content organizations may meet the same fate if Mizkif fails to provide evidence to back his claims.
While the lawsuit and related claims against

have now been dismissed, Mizkif’s suit against Emiru, OTK, Mythic Talent, and King Gaming Labs remains ongoing. Court filings for the other defendants have not been released as of yet, indicating that those legal process hasn’t concluded. It’s unclear how long the process will take, but related court filings are expected to be released publicly in due course and will surely generate much discussion around the streaming community when they do.
