Kalshi Hits Netflix With Cease-and-Desist Over Documentary Trailer

Kalshi, one of the most popular prediction markets, is in a legal dispute with streaming platform Netflix after the trailer for a new documentary was released. Kalshi has responded by threatening legal action over claims of defamation. This centers on a scene in the trailer where traders were depicted making predictions in states where it is not permitted to do so.

The trailer for Instadocs: The Prediction Market Games, a Netflix documentary, shows people in Nevada making predictions on the 2026 World Cup. One trader has a Kalshi receipt for $5,000 on Spain winning the trophy. The participant also says they “like” using Kalshi for sports predictions.

Kalshi threatens Netflix ahead of new documentary

Prediction markets have become mainstream in a short space of time. Platforms like the Kalshi app and Polymarket have gone from a niche part of sports culture to a wide-reaching multi-billion-dollar industry. Prediction markets are distinct from sports betting, offering traders the chance to buy contracts and predict outcomes across sports, politics, entertainment, and many other niches.

This sparked the documentary that has gotten the attention of Kalshi and may have kickstarted a legal spar between the two. What will come of the cease-and-desist remains to be seen, but the documentary went live on the Netflix platform on July 26.

Because the trailer depicts a sports-related trade taking place in Nevada, Kalshi has sent Netflix a cease-and-desist letter. Kalshi is currently barred from offering sports event contracts in the state due to ongoing litigation with Nevada regulators. The prediction market company argues that Netflix is defaming it by implying that the trade shown in the trailer occurred during the actual World Cup in July. According to to the prediction market platform, such a trade could not legally have taken place in Nevada at that time.

As reported by The Hollywood Reporter, the cease-and-desist letter argues that the statements made in the trailer are false and that they “jeopardize Kalshi’s legal standing in litigation,” which would potentially harm their ability to do business. The defamation allegation is not about the public perception of the prediction market. Instead, Kalshi argues that the trailer could undermine its position in ongoing litigation, potentially affecting its efforts to expand its business.

Furthermore, Kalshi has produced evidence to back up its claim. The phone screen shown in the trailer displays a date of May 2025, which the company argues demonstrates that the Spain trade did not occur after the Nevada restrictions took effect. The image also has a “crop” option, indicating that it’s a screenshot rather than an actual, current prediction. Netflix has claimed that the footage actually was filmed in July 2026 in Las Vegas.

Prediction markets have exploded in recent months and are now very much in the public consciousness. News is often presented with a prediction market slant, such as the percent chance that Congressional salaries will increase. Video games have come under this, too. There are predictions on the next Game of the Year, a game’s Metacritic score, and much more.

So, it is probably a good thing that someone, even if it’s the controversial Netflix, is exploring the rapid rise of prediction markets like Kalshi. But journalistic accuracy has to reign supreme here. It is one thing to paint prediction markets in a negative light, but it’s another to do it falsely and to imply that they are in legal violation when they may not be.

It remains to be seen what the outcome of this legal process will be: court battles are no fun, and cease-and-desist letters can leave a bad taste in the mouth. But in this case, Kalshi seems to have genuine reasons to feel aggrieved.
