Supreme Court in India sets hearing on online gambling ban

Regulators and operators in India have been battling back-and-forth over a nationwide ban on real-money online gambling, and a Supreme Court hearing slated to decide the fate of the related law is now set for the very near future.

Physical gambling operators and Indian regulators want online casinos and betting to be prohibited in India, citing industry concerns for potential lost jobs because of digital competition as well as safety considerations. Online operators want to be able to run their businesses freely while observing best practices, offering more options and more competitive opportunities for bettors in India. The nation’s Supreme Court was slated to hear the matter and make a decision, but with the future of online gambling in the country remaining uncertain, the hearing has been moved to early 2026.

This leaves players and operators stuck in limbo, waiting for that big decision to be made.

Indian Supreme Court to decide future of online gambling in January 2026

The Indian Supreme Court as announced its intentions to address the case over the legality of online gambling in the country come January 2026, and that decision is set to carry substantial weight in one of the world’s most populous nations.

India introduced the Promotion and Regulation of Online Gaming Act, 2025 (PROGA) in August, which prohibits any online gambling that deals in real money. The law was introduced at the insistence of physical operators who fear online competition could ultimately be detrimental to them. Supporters also alleged that online gambling will make financial crimes easier and harder to trace, the operators counter that local, regulated online betting actually makes it easier to track betting activity, particularly relative to when those activities are otherwise channeled through offshore operators with few, if any, regulations.

Indian online gambling ban

India is moving closer to a decision on an online gambling ban.

Online gambling operators have challenged the validity of the law, citing that the legislation violates the Indian Constitution and the law’s inability to differentiate between games of chance and skill-based games such as online poker or esports competitions. Operators found in violation of the law can face prison terms of up to three years and financial fines.

PROGA aims to protect physical gambling operators, but online casino regulators argue it has put jobs linked to digital gambling at stake and would severely limit the options available to bettors. These points prompted the Indian Supreme Court to decide to hear and rule on the legality of the act. But the hearing has since been moved to January 2026, with online gambling operators criticizing the postponement and alleging that the delay constitutes an effective enforcement of the law in the meantime.

The wait for the final decision is also a potential cause of loss of revenue for the online gambling industry, with investments possibly being pulled and moved elsewhere. There is also a cause of worry for players, as it’s uncertain whether some money could be lost because of platform shutdowns.

Millions of Indians bet online, but this law and the resulting delay in the Supreme Court ruling may see many move to overseas alternatives. This is a scenario that other countries like New Zealand are trying to avoid, to better capitalize on local gambling revenues. If the law is carried forward, it could ultimately be a loss for both the online gambling industry and India’s economy.
